- Secure Messaging: End-to-end encrypted messaging to ensure privacy and security.
- User Authentication: Only registered users can send messages via the application.
- Subscription-Based Access: Our services require an active subscription for usage.
3. Subscription & Payment Terms
To access our applications, users must subscribe to a monthly or annual auto-renewable plan.
- Billing & Renewals: Subscriptions are charged through Apple, Google, Stripe, or any other supported payment providers upon purchase confirmation and will automatically renew unless cancelled at least 24 hours before the current period ends.
- Cancellation: Users can manage or cancel their subscriptions anytime through their respective Apple ID, Google Play, Stripe dashboard, or other payment account settings.
- Refunds: We do not process refunds. All refund requests must be handled directly through the respective payment provider (Apple, Google, Stripe, etc.).
- Additional Charges: Some apps may charge additional fees for extra usage beyond the standard plan limits.
Failure to make payments may result in suspension or termination of services.
4. User Responsibilities
By using our services, you agree to:
- Provide accurate registration details, including name, phone number, and email address.
- Secure your account credentials and ensure unauthorised persons do not access your account.
- Use the service legally and ethically. Any misuse, including spamming, harassment, or unauthorised access attempts, will result in account termination.
- Be responsible for messages you send and receive. Since we do not store or retain messages, you must keep your data safe from unauthorised access.
5. Data Protection & Security
We take your privacy seriously and implement strict security measures. However, we do not store or retain any message data after transmission.
Responsibility for Sent & Received Messages
Once an SMS message is sent or received through our App:
- Defesio has no control over it.
- The recipient is solely responsible for keeping their data safe.
- We do not store or retain messages after they are sent.
- Users must ensure their device is secure to prevent unauthorised access to received messages.
- Defesio is not liable for any security breaches, unauthorised access, or misuse of messages once they are received on a user’s device.

6. Account Management
Account Deletion
Users have full control over their accounts and may request account deletion at any time.
- Account deletion is permanent and results in the loss of active subscriptions and associated data.
- A confirmation email will be sent before deletion. Users must confirm via email to complete the process.
- Defesio is not responsible for accidental account deletions.
Password Recovery
If you forget your password, use the “Forgot Password” option on the login page. Follow the instructions sent to your registered email to reset your password.
7. Service Limitations & Warranty
- Our services rely on third-party infrastructure (such as Apple, Google, Stripe, and telecommunications providers). We do not guarantee uninterrupted service due to network issues, device limitations, or regulatory restrictions.
- We are not liable for any direct or indirect damages resulting from the use or inability to use our services.
- We do not guarantee message delivery if issues arise from network errors, recipient device settings, or spam filtering mechanisms.
8. Acceptable Use Policy
You agree not to use our services for:
- Sending spam, abusive, or illegal content.
- Engaging in harassment, impersonation, or fraud.
- Distributing malware, hacking, or attempting to breach security measures.
- Violating applicable laws, regulations, or TCPA compliance standards.
Violation of these terms may result in account suspension or permanent termination without notice.
9. Termination of Services
We reserve the right to suspend or terminate your account if you:
- Violate these Terms of Reference.
- Fail to make payments for a subscription plan.
- Engage in fraudulent, illegal, or abusive activity.
Either party may terminate the agreement with prior written notice. Refunds (if applicable) will be determined based on the work completed and Apple, Google, Stripe, or other payment provider’s refund policies.
10. Governing Law & Dispute Resolution
These terms are governed by the laws of the United States and Canada, depending on the user’s jurisdiction and the applicable legal framework.
Any disputes arising from or relating to these terms shall be resolved through arbitration or legal proceedings in the appropriate jurisdiction. Users agree that:
- If residing in the United States, disputes will be governed by U.S. laws and resolved in a U.S. court or arbitration tribunal.
- If residing in Canada, disputes will be governed by Canadian laws and resolved in a Canadian court or arbitration tribunal.
- In cases where international laws apply, arbitration shall be the preferred method of dispute resolution, conducted in accordance with internationally recognized arbitration rules.
11. Changes to Terms & Conditions
We reserve the right to update these terms at any time. Users will be notified of any significant changes. Continued use of our services after changes indicates acceptance of the new terms.
